By downloading, installing, or using the MindMate mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our App.

These Terms constitute a legal agreement between you and MindMate regarding your use of our services.

2. Description of Service

MindMate is a mental wellness and mood tracking application that provides:

• Daily mood tracking and emotional logging
• AI-powered coaching and conversation features
• Personal insights and analytics based on your mood data
• Wellness goals and progress tracking
• Personalized recommendations for mental wellness

3. User Accounts and Responsibilities

Account Creation

• You may create an account using your email address or social media accounts
• You can also use the app as a guest, but some features may be limited
• You must provide accurate and complete information when creating your account

Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You agree to notify us immediately of any unauthorized use of your account
• You are responsible for all activities that occur under your account

Age Requirements

• You must be at least 13 years old to use MindMate
• Users between 13-17 should have parental guidance when using mental health apps
• By using the app, you represent that you meet these age requirements

4. Acceptable Use

You agree to use MindMate only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the app for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Share your account credentials with others
• Use automated systems or scripts to access the app
• Reverse engineer, modify, or create derivative works of the app
• Upload harmful code, viruses, or malicious software
• Harass, threaten, or impersonate others through the app
• Use the app in any way that could harm our services or other users

5. Premium Services and Subscriptions

Subscription Terms

• Premium subscriptions are available monthly or annually
• Subscriptions automatically renew unless cancelled before the renewal date
• You can cancel your subscription at any time through your app store account settings
• Cancellations take effect at the end of the current billing period
• No refunds are provided for partial subscription periods

Free Trial

• New users may receive a free trial period for Premium features
• You must cancel before the trial ends to avoid being charged
• Trial length and availability may vary and are subject to change

6. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Limitation of Liability

To the maximum extent permitted by law:

• MindMate is provided "as is" without warranties of any kind
• We do not guarantee that the app will be error-free or uninterrupted
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability to you shall not exceed the amount you paid for Premium services in the past 12 months
• Some jurisdictions do not allow these limitations, so they may not apply to you

10. Termination

Either party may terminate your access to MindMate:

• You may delete your account at any time through the app settings
• You may stop using the app at any time
• You can request data deletion through our data deletion tool

Our Right to Terminate

• We may suspend or terminate accounts for violations of these Terms
• We may discontinue the service with 30 days' notice
• We reserve the right to refuse service to anyone for any reason

Effect of Termination

• Upon termination, your right to use the app ceases immediately
• We will delete your data in accordance with our Privacy Policy
• Premium subscriptions will continue until the end of the current billing period

11. Updates and Changes

We may update MindMate and these Terms from time to time:

• App updates may be required to continue using the service
• We will notify you of material changes to these Terms
• Your continued use after changes constitutes acceptance of the new Terms
• We recommend reviewing these Terms periodically

12. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
